LEGAL NOTICE AND GENERAL DIRECT BOOKING TERMS

1. Operator

2. Formation of the booking

Before booking, guests are shown the accommodation, dates, occupancy, total price including taxes, arrival and departure times, payment method, cancellation policy and essential house rules. The contract is formed when the guest expressly accepts these terms and receives confirmation by email. The booking is personal and applies only to the declared accommodation, dates and guests.

3. Deposit and confirmation

To secure the booking, a bank-transfer deposit of 30% of the total price must be paid within 48 hours of the payment request. Proof of payment must be sent to starclients@bookmecanary.com, stating the guest name and stay dates. If payment is not received, BookMeCanary will, whenever reasonably possible, send a reminder granting a further 24 hours. If no payment or reply is received by then, BookMeCanary may cancel the request and release the dates.

4. Final payment

The remaining 70% must be received no later than 14 calendar days before arrival. For bookings made fewer than 14 days before arrival, 100% must be paid within 24 hours of the payment request and before access instructions are provided.

5. Cancellation by the guest

  • 30 calendar days or more before arrival: full refund of amounts paid.
  • 15 to 29 days before arrival: a maximum of 30% of the total price may be retained.
  • Within 14 days of arrival, no-show or early departure: up to 100% of the total price may be retained.

Cancellations must be made in writing. If the dates are rebooked, BookMeCanary will refund the recovered amount exceeding reasonably evidenced losses, price differences and costs.

6. Right of withdrawal

Because the service is accommodation for specified dates, the general 14-day withdrawal right does not apply, without prejudice to the guest’s mandatory consumer rights.

7. Cancellation by BookMeCanary

If BookMeCanary cannot provide the accommodation for a reason attributable to it, it will offer, where possible, equivalent or superior accommodation at no extra charge, or a full refund. Acceptance of an alternative is voluntary.

8. Extraordinary circumstances

If a legal prohibition, mandatory evacuation, official closure or other extraordinary and unavoidable event objectively prevents the accommodation service, the parties will act in good faith to agree a date change, credit or refund in accordance with applicable law and services actually provided.

9. Occupancy, access and conduct

The authorised capacity must not be exceeded and undeclared guests are not permitted. Guests must provide legally required traveller-registration information, respect arrival and departure times, house and community rules, avoid excessive noise and refrain from parties or illegal activities. Access instructions are supplied after payment and all pre-arrival requirements have been completed.

10. Damage and cleaning

Standard final cleaning is included. Additional cleaning is charged only when expressly requested and accepted. The lead guest is responsible for damage caused intentionally or negligently by the guest or accompanying persons. BookMeCanary must evidence the damage and reasonable cost; ordinary wear and tear is not chargeable.

11. Issues and liability

Guests must report any deficiency as soon as reasonably possible so that it can be checked and remedied. Nothing in these terms limits mandatory consumer rights or liability that cannot legally be excluded.

12. Privacy and complaints

Personal data is processed to manage the booking, accommodation, payments and legal duties in accordance with the Privacy Policy linked during booking. Official complaint forms are available. Questions and complaints may be sent to starclients@bookmecanary.com.

13. Governing law and jurisdiction

Spanish law and the tourism and consumer rules applicable in the Canary Islands apply, without prejudice to any mandatory consumer forum. For Booking.com, Airbnb, FeWo-direkt or other platform reservations, the terms expressly accepted on that platform prevail.

14. Acceptance

By ticking the acceptance box, the guest declares that these terms were read and accepted before booking. BookMeCanary will retain the applicable version, acceptance date and booking confirmation.
